Granted, it nicely nudges discussion away from defining a person and more about recognizing trends. Which seems far less arrogant. Either way, you can instantly reduce impulsive/political decisions by 25 percent by simply raising the threshold for action.

Restrict Access Report via Cohorts
I build compliance training and reporting for employers across multiple states, so I'm constantly dealing with "we need the insight" vs "don't create a surveillance culture." The fastest way to lose trust is to let people think training/compliance data is being used to grade them personally.

Most companies over-collect and under-act. They hoard employee data like it's gold, then wonder why people feel surveilled. The real discipline is in restraint, not access.
At Magic Hour, we're a two-person team, so our "people decisions" look different than a 500-person org. But I've seen this play out up close. Court records, professional license verifications, employment history — that's all fair. It's either public record or something the person told you. The moment you start digging into things they never shared, you've broken trust even if you haven't broken any rules.
Something that actually helped was separating verification from evaluation. Verification is just confirming what someone already told you. That's objective, it's defensible, and most people are fine with it. The problems start when you use information they didn't provide to form opinions about them. That's where it gets murky — legally and ethically.
For most decisions, three things cover what you actually need to know: a court records check, a license verification if the role requires one, and confirming the employment history they gave you. Anything beyond that should have a specific reason behind it — and that reason should be written down somewhere.
Honestly the bigger issue is that most organizations never tell people what they're checking. A simple one-liner — "we verify court records and employment history" — does more for trust than a dense consent form nobody reads. People aren't opposed to background checks. They're opposed to feeling like something is being done to them without explanation.
